Flowflex™ COVID-19 Rapid Antigen Test Money Back - Terms of Service

1. Definitions

a. Prenetics Limited (“Prenetics”, “we”, “us” and “our”) has its principal place of business at 701-706 K11 Atelier, 728 King’s Road, Quarry Bay.

b. "Product" means the Flowflex™ COVID-19 Rapid Antigen Test purchased from Authorised Retailers published on Project Screen's Flowflex COVID-19 Rapid Antigen Test website.

c. “Service” means the 100% money back guarantee detailed in section 4 of this TOS.

d. "Personal Information" is information that can be used to identify you, either alone or in combination with other information. Prenetics collects and stores the following types of Personal Information: name, email address, telephone number, Hong Kong Identity Card details.

e. “Authorised Channel” means Prenetics’ official website, participating retail channels or authorised retailers in Hong Kong

2. Acceptance of Terms

a. Your use of the Service is subject to these Terms of Service ("TOS").  

B. Use of the Service is deemed to be an acceptance of these TOS.

3. Eligibility 

This Service is open to all Hong Kong residents of 18 years old and above who are holders of a valid Hong Kong Identity Card (“Claimant”) and have purchased a Product from an Authorised Channel. A Claimant may submit a claim on behalf of a person who is under 18 years of age if the Claimant is the person’s legal guardian or parent.  

Employees, shareholders, officers, directors, agents, distributors and representatives of Prenetics and each of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives and advertising agencies, together with the immediate family members (regardless of where they live) and those living in the same household of such persons (whether or not related), are not eligible to claim the Service.

Prenetics reserves the right to disqualify any claimant who does not comply with any of the TOS of this Service or if Prenetics is of the view that the claimant fails to satisfy any of the Service’s criteria.

4. The Service

The Service applies to the Product you purchased from Prenetics retail channels or our Authorised Retailers published on Project Screen's Flowflex COVID-19 Rapid Antigen Test website.

If you are not satisfied with the Product in regards to its accuracy, when using the Product in accordance with the Instructions for Use,  Prenetics will, at your election:

Upon verification of purchase, refund you the purchase price of the Product via Bank Transfer provided that official receipt is submitted. Prenetics reserves the right to disqualify any illegible, disfigured or modified receipts. 

Please allow up to 7 business days from the date that we accept the claim for us to provide you with a refund. If you purchased the Product in conjunction with a cash-back, voucher, or discount promotion, we will deduct the value of that promotion from any refund we provide to you under the Service.

The Service is restricted to Hong Kong bank accounts only. Refund via Bank Transfer shall include full refund of Product cost and courier charges.

Products purchased during promotions such as cash backs, discounts and voucher promotions, refunded amount will be that of price deducted based on the value of the discount or voucher promotion.

You may make one (1) claim in respect to any used Flowflex™ COVID-19 Rapid Antigen Test that you are not satisfied with.

Any additional kits that have been purchased within the same receipt and that remain unopened and unused will also be eligible for the Service. Any unopened, unused Products must be returned prior to processing the refund.

The Service must be claimed within 3 months of purchase of the Product and before the Product’s expiry date stated on the box.

5. How To Claim The Service

Submit your claim via email to support@prenetics.com within 3 months of purchasing the Product, with details on how the Product has yielded inaccurate results.

Requirement:

  • Submit a clear explanation to support@prenetics.com, stating your reason for claiming under the Service
  • ~The claim must include a photo of the inaccurate test side by side with another Rapid Antigen Test taken on the same day. The photo must clearly show that the two tests present a different result.
  • ~You must state in the claim that you certify the two tests were done on the same day, and that the tests have not been tampered with in any way. 
  • ~Any statements and submissions made must be truthful. Prenetics reserves the right to refuse the refund if we suspect that the tests have been tampered with.

  • Submit details of the Product purchased, including:
  • ~Product Name
  • ~Quantity
  • ~Submit proof of purchase:
  • ~Scanned copy of original sales receipt from Prenetics retail channels or our authorised retailers.

Please ensure any email or post correspondence clearly identifies who you are and provides your contact telephone number and/or email address for us to reply to.

Any charges/costs incurred by you (including cost of postage) during the course of this Service is to be fully borne by you.

6. General

a.If for any reason the Service is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of Prenetics which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Service, Prenetics reserves the right in its sole discretion to disqualify any individual who it suspects to have acted improperly, or to cancel, terminate, modify or suspend the Service.

b.Nothing in these TOS limits, excludes or modifies or purports to limit, exclude or modify any consumer rights that are not excludable under Hong Kong laws. Except for any liability that cannot by law be excluded, Prenetics (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Service.

c. Prenetics collects personal information in order to conduct the Service and may, for this purpose, disclose such information to third parties who are assisting with the administration of the Service, including but not limited to agents, service providers and suppliers. Prenetics may also use the data collected for re-targeting purposes such as communications, targeted advertising as well as product recommendations. You may opt-out of such communications, targeted advertising and product recommendations by emailing your request to support@prenetics.com.

d.Prenetics reserves the right to vary, extend, suspend or terminate this Service at its sole discretion.

e.Claim forms that are incomplete, illegible, damaged, delayed or do not have valid or adequate proof of purchase will be disqualified.

f.Proof of postage of the claim form and Product (s) will not constitute proof of receipt. Prenetics will not be held liable in the event of non-receipt of claims sent by the claimant.

7. Privacy and Disclosure of Information

a.Your privacy is important to us. We comply with the applicable requirements of the Personal Data (Privacy) Ordinance in Hong Kong SAR and other applicable regulations specific to Hong Kong SAR. By agreeing to this TOS you acknowledge that such laws and regulations regarding collection, use, processing, and storage of your Information shall govern our performance of the Service and handling of your Personal Information.

b. While we cannot guarantee that unauthorised access, disclosure, misuse or loss of information will never occur, we implement and frequently review certain physical, managerial, and technical safeguards that are designed to protect the confidentiality, integrity and availability of your information and to prevent information security incidents. In the event of a security incident or data breach, we will follow internal procedures to investigate the matter as well as comply with all applicable regulatory requirements.

8. Limitation of Liability and Indemnification

Within the limits allowed by applicable laws, you expressly acknowledge and agree that we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use any Service; (ii) any delay in any part of a Service; or (iii) any action you take based on the information you receive in through or from any Service.

9. Changes to the Terms of Service

a.Prenetics may make changes to the TOS from time to time. When these changes are made, Prenetics will make a new copy of the TOS available on its website and any new additional terms will be made available to you from within, or through, the affected Services.

b.You acknowledge and agree that if you use the Services after the date on which the TOS have changed, Prenetics will treat your use as acceptance of the updated TOS.

10. Violation or Suspected Violation of Terms of Service

If you violate the terms of these TOS and/or Prenetics has a reasonable ground to suspect that you have violated the terms of these TOS, Prenetics has the right to refuse your eligibility for any and all current or future use of the Service (or any portion thereof).

11. Miscellaneous

a.Entire Agreement. The TOS constitutes the entire agreement between you and us and govern your use of the Service, superseding any prior agreements between you and Prenetics on this subject. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software.

b.Applicable law and arbitration. Any dispute, controversy, difference or claim arising out of or relating to this contract, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to the Services and TOS shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The law of this arbitration clause shall be Hong Kong law. The seat of arbitration shall be Hong Kong.

c.Waiver. The failure of us to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found to be invalid, the parties nevertheless agree to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

d.Severability Clause. If any portion of these TOS is found to be unenforceable, the remaining portion will remain in full force and effect.

e.Amendments. We reserve the right to modify, supplement or replace the terms of the Agreement, effective upon posting at projectscreen.co or notifying you otherwise.

f.Language. This Agreement is made into Chinese and English. In case of any discrepancies between the English and Chinese versions, the English version shall prevail.

Privacy Statement

In order to use the Services, you must first acknowledge and agree to the Privacy Statement. You may not use the Services if you do not accept the Privacy Statement. You can acknowledge and agree to the full Privacy Statement, which is incorporated by reference into these Terms, by (1) clicking to accept or agree to our Privacy Statement, where this option is made available to you by Prenetics for any Service; or by (2) actually using the Services.

You acknowledge and agree that Prenetics has the right to monitor any use of its systems by its personnel at any time and maintain copies documenting such monitoring. Our Privacy Statement sets forth the only expectations of privacy any individual should have in terms of usage of the Project Screen Services, website, or other systems.

Your personal data, including without limitation the personal data obtained from you directly when you provide us with personal information, e.g. when you submit a claim under our Service, will be processed for the purpose of your participation in our Services. Any information derived from you is subject to rights we retain as set forth in these TOS.

We also wish to inform you that your Personal Data may be disclosed to third parties, such as to our headquarters, regional offices, subsidiaries, affiliates and/or members within Prenetics, and/or our service providers, which may be located outside Hong Kong, for reasons relating to the Purpose. Kindly note that it will be necessary for us to process your Personal Data, without which we will not be able to carry out the Service. 

Further, you acknowledge and agree that Prenetics is free to preserve and disclose any and all Personal Information to law enforcement and Department of Health agencies: (a) comply with legal process (such as a judicial proceeding, court order, or government inquiry) or obligations that Prenetics may owe pursuant to ethical and other professional rules, laws, and regulations; (b) enforce this TOS; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Prenetics, its employees, its users, its clients, and the public. In such an event we will notify you through the contact information you have provided to us in advance, unless doing so would violate the law or a court order. You understand that the technical processing and transmission of the Services, including your Personal Information, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks, or devices. Finally, Prenetics may, in its sole discretion, restrict access to the website for any reason.
